Spencer A. Kinderman is a member of the Labor & Employment practice group. His practice is focused exclusively on representing employers in labor and employment related legal matters, including employment litigation, employment counseling, labor relations and union avoidance, regulatory compliance and workplace health and safety.
He represents employers in state and federal courts in employment related litigation, including claims of employment discrimination, retaliation, wrongful discharge, wage and hour violations, benefits disputes, and breach of non–competition/non–solicitation agreements. His experience includes handling complex employment litigation such as wage and hour collective actions, employment discrimination class actions and ERISA litigation.
Spencer also routinely represents employers before state and federal administrative agencies such as the EEOC, NLRB, DOL, OSHA, OFCCP and ICE, assisting employers with agency investigations and responding to administrative charges.
In the area of traditional labor law, Spencer works closely with employers in all aspects of labor–management relations, including union organizing activity, union elections, collective bargaining negotiations, strikes, grievance processing and labor arbitrations. Spencer also assists employers in developing and carrying out union avoidance programs.
On a daily basis, Spencer assists employers with developing, implementing and enforcing workplace policies and procedures, including employee handbooks and mandatory arbitration programs. He frequently advises employers on an ad hoc basis regarding day–to–day personnel issues, including the hiring, discipline and termination of employees. A member of several ABA committees, including the Employee Benefits, Federal Wage and Hour Legislation and EEO Committees, Spencer is a contributing author to Age Discrimination in Employment Law (BNA) and Employee Benefits Law (BNA).
Spencer frequently speaks to employer groups and associations on workplace legal issues.
